Disciplinary Council

The Disciplinary Council is a body provided for in the Professional Code of Quebec. Its mandate is to hear complaints submitted either by the Syndic's Office or by an individual (a private complainant) against a psychologist, accusing him or her of violating the Professional Code, the Code of Ethics, or the rules of the Order. It also assigns penalties if the psychologist is found guilty of the infraction.

The council consists of three members: a chairperson, named by the government, who must be an attorney, and two psychologists named by the Order's Board of Directors.

The hearings of the Disciplinary Council are open to the public, unless the council decides to go to an in camera session. The schedule of disciplinary hearings lists the name of the psychologist involved, the nature of the complaint, and the location and time of the hearing.

If one of the parties is not satisfied with the decision of the Disciplinary Council, he or she may appeal to the Professions Tribunal following the decision. However, if the complaint was lodged by the Syndic's Office, only it or the psychologist involved may appeal the decision.
